Privacy statement

  1. Application

This privacy statement applies to the following categories of individuals whose personal data are processed by Embion B.V. located at Kalundborg no. 10, 5026 SE Tilburg, hereinafter referred to as Embion:

  • (potential) customers and/or (end) users of our products, licences, and services;
  • Visitors to our website;
  • Recipients of our newsletters;
  • Participants in meetings organised by us;
  • Applicants;
  • All other people who contact Embion or whose personal data Embion processes
  1. Processing of personal data

Embion processes personal data that:

  • You have provided yourself, for example when concluding an agreement, through registration of a license, by telephone, by e-mail, or through web forms on Embion's website (such as: name, email address, telephone number, address, function, company name);
  • During a visit to the Embion website or while reading digital newsletters, data may be generated, such as browsing behaviour on the website (including information about the first visit, previous visit, and current visit, the pages viewed, and how the website is navigated) or whether the individual opens a newsletter or commercial email and which parts of it they click on;
  • Data may also be generated when using Embion's products, licenses, and services, such as log data;
  • Embion may obtain data from other sources, including business social media platforms like LinkedIn, public business websites, the Trade Register of the Chamber of Commerce, and the Land Registry, such as completed and necessary contact details and other personal data.

The Embion website contains hyperlinks to websites of other parties and social media buttons (LinkedIn, Facebook, Instagram). When these buttons are clicked, personal data is processed by the respective social media platform. Embion is not responsible for the content of these websites or the services of these social media platforms. Nor is Embion responsible for the privacy policies and the use of cookies on these websites and social media platforms. For information on how LinkedIn, Facebook, and Instagram handle personal data, please refer to the privacy statements of these platforms.

  1. Purposes of Processing

Embion processes personal data for one or more of the following purposes:

  • To execute agreements;
  • To deliver and maintain our products, licences, and services, including monitoring usage and improving quality; 
  • The personal data you provide may grant you access to various functionalities of the licenses and services available to you as a registered user;
  • To contact you via email, phone calls, or other equivalent forms of communication, such as account activation and notifications;
  • To manage requests;
  • To send invoices;
  • To keep user statistics (user statistics of the website provide information about the number of visitors, the duration of the visit, which parts of the website are viewed, and click behavior. These are generic reports that cannot be traced back to individual visitors).

Embion may also share your personal data with business partners and other users.

  1. Legal Basis

Embion processes personal data based on one or more of the following legal grounds:

  • Your consent, which can always be withdrawn without affecting the lawfulness of processing based on consent before its withdrawal;
  • The performance of, or in order to enter into, an agreement;
  • A legal obligation;
  • A legitimate interest, such as using contact details to invite you to a meeting, send you a newsletter, or improve our services.

In order to provide services and comply with legal obligations, it is necessary for you to provide us with personal data. Without personal data, we may be less able to approach you effectively and optimise our business operations.

  1. Processors

Embion may engage service providers (processors) for processing personal data, who will only process personal data according to Embion’s instructions. A processor is a party that processes personal data solely on the instruction of the data controller (for example, an IT provider who manages and secures the IT environment). Embion enters into a data processing agreement with processors that meets the requirements set out in the General Data Protection Regulation (GDPR).

  1. Sharing Personal Data with Third Parties

Embion shares personal data with third parties only if it is necessary to comply with a legal obligation or if it is required for the performance of contracts.

An example of complying with a legal obligation could include reporting unusual transactions to supervisory authorities.

Embion does not share personal data with third parties for commercial purposes.

  1. Transfers Outside the EEA

As a general rule, Embion does not transfer personal data to countries outside the European Economic Area (EEA). If this becomes necessary, Embion ensures that the transfer only takes place if the European Commission has indicated that the relevant country provides an adequate level of protection or if there are appropriate safeguards in accordance with the General Data Protection Regulation.

  1. Data Retention

Embion does not retain personal data longer than necessary. If you have an agreement with Embion and that agreement ends, Embion will delete your personal data, unless there are legal grounds for retention.

  1. Changes to Privacy Statement

Embion may amend its privacy statement at any time. Any changes will be published on the Embion website. We recommend regularly reviewing the privacy statement to stay informed about any changes.

  1. Rights, Questions, and Complaints

As a data subject, you have the right to request Embion to access, rectify, delete, transfer, restrict processing, and object to the processing of your personal data.

You can contact Embion about this by sending an email to info@embion.nl. To prevent misuse, we ask you to adequately identify yourself when making your request by providing a copy of a valid ID. Please remember to redact your BSN (citizen service number) and photo on the copy.

If you have any questions or complaints regarding how Embion processes personal data, you can also contact Embion by sending an email to info@embion.nl. We will aim to resolve any complaints to your satisfaction. However, if this is not possible, you have the right to file a complaint with the Dutch Data Protection Authority (www.autoriteitpersoonsgegevens.nl).
